Terms and Conditions for Momentum Munchies
Introduction
Welcome to Momentum Munchies. These Terms and Conditions govern your use of our online platform and the services we offer, including bespoke cake design, artisanal pastry creation, gourmet cupcake production, custom celebration cakes, dessert catering, and baking workshops. By accessing or using our services, you agree to comply with and be bound by these terms. If you do not agree with any part of these terms, you must not use our services.
1. Acceptance of Terms
By using this website, placing an order, or registering for a workshop, you signify your acceptance of these Terms and Conditions. We reserve the right to modify these terms at any time, so please review them frequently. Your continued use of our services following any changes signifies your acceptance of those changes.
2. Services Provided
- Bespoke Cake Design & Custom Celebration Cakes: All custom orders require a detailed consultation and agreement on design, flavours, and pricing. A non-refundable deposit may be required upon confirmation.
- Artisanal Pastry & Gourmet Cupcake Production: Availability of products may vary. We strive for consistency in quality and presentation.
- Dessert Catering: Catering services are subject to availability and specific agreements regarding menu, delivery, and setup.
- Baking Workshops: Enrollment in workshops is subject to availability and full payment. Cancellation policies apply.
3. Ordering and Payment
- All orders are subject to availability and confirmation.
- Prices for our products and services are listed on our site and are subject to change without prior notice.
- Full payment is required for all online orders at the time of purchase, unless otherwise agreed for custom orders or catering.
- For custom or catering orders, a deposit may be required to secure your booking, with the remaining balance due on or before delivery/collection.
4. Cancellations and Refunds
- Product Orders: Cancellations for standard online orders must be made at least 48 hours prior to the scheduled pick-up or delivery time for a full refund. Less than 48 hours notice may result in a partial or no refund, depending on the stage of preparation.
- Custom & Catering Orders: Deposits for custom and catering orders are non-refundable. Cancellations closer to the event date may incur additional charges up to the full order value. Specific terms will be outlined in your custom order agreement.
- Baking Workshops: Full refunds for workshop cancellations are provided up to 7 days before the workshop date. Cancellations made within 7 days of the workshop are non-refundable but may be eligible for a credit towards a future workshop at our discretion.
5. Allergens and Dietary Requirements
Momentum Munchies handles various ingredients, including but not limited to nuts, dairy, gluten, soy, and eggs. While we take precautions to prevent cross-contamination, we cannot guarantee that any product is completely free of allergens. It is your responsibility to inform us of any allergies or dietary requirements at the time of ordering. We will do our best to accommodate, but cannot be held liable for allergic reactions.
6. Intellectual Property
All content on this website, including but not limited to text, graphics, logos, images, and culinary designs, is the property of Momentum Munchies and is protected by New Zealand and international copyright laws. You may not reproduce, distribute, or transmit any content from our site without our express written permission.
7. Limitation of Liability
Momentum Munchies will not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use our services; (ii) any conduct or content of any third party on our services; (iii) any content obtained from our services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

These Terms and Conditions shall be governed and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.
